Terms of service

Terms of Use

Customers using “ZenSei” (hereinafter referred to as “the Service”), operated by Wakapal Co., Ltd. (hereinafter referred to as “the Company”), shall use the Service in accordance with the following Terms of Use (hereinafter referred to as “these Terms”).
By using the Service, customers are deemed to have agreed to the contents of these Terms.
Furthermore, any additional items, provisions, or rules specified within the Service, regardless of their designation, shall constitute part of these Terms.

Changes to Service Content

  • The Company may change, suspend, or discontinue the Service content at any time without prior notice to customers.
  • The Company may revise these Terms without prior notice. Revised Terms will be displayed within the Service without delay; please regularly check for the latest content.

Email Address and Password

  • If you are a registered member, you are responsible for managing your ID and password.
  • Any actions taken using your ID and password shall be deemed the responsibility of the member holding that ID.
  • If your ID is used without your permission, or if your ID and password are leaked to a third party, please contact us immediately.
  • When temporarily ending your use of the service, please log out each time.
  • We shall not be liable for any damages arising from the leakage or unauthorized use of your ID and password, except in cases of intentional misconduct or gross negligence on our part.

Notifications and Communications

  • When we determine it necessary to notify or contact you, we will do so via email and other methods we deem appropriate.

Your Responsibilities

  • All creative works such as illustrations, comics, photographs, paintings, logos, novels, lyrics, and other documents created by someone other than the customer (hereinafter referred to as “Content”) generally belong to third parties other than the customer, who hold intellectual property rights such as copyrights and trademark rights over the Content. (Note: Even for Content created by the customer themselves, permission from the rights holder may be required separately if ① it was created for work purposes or ② intellectual property rights have been transferred to a third party.)
  • To use such Content, you must obtain permission from the third party holding the relevant intellectual property rights. When using this Service with Content created by someone other than yourself, you must always obtain permission from the third party holding the intellectual property rights.
  • You are solely responsible for any Content you post, disclose, provide, or send to others using this Service as a medium. Please fully understand that if you use content for which a third party holds intellectual property rights without the rights holder's permission, you may (1) face criminal penalties, (2) be subject to claims for damages, or (3) have objections raised by the third party.
  • Please fully understand that the Internet is used across national borders and comply with the regulations of the country or region where you are using the Service regarding online conduct and what content is permissible.
  • We do not manage any content posted, disclosed, provided, or sent by you to others through this service, nor do we guarantee the reliability, truthfulness, or legality of such content.
  • Furthermore, we assume no responsibility whatsoever on your behalf.

Regarding Your Purchase

  • Depending on the content of the design you order, we may be unable to accept your application. Even after a contract is formed between our company and you, we may terminate that contract.
  • If it is discovered that content used in the product you ordered may infringe upon a third party's intellectual property rights, such as copyrights, trademark rights, or design rights, we may suspend production or shipping of the product at any time and terminate the contract.
  • If a minor applies, consent from a parent or guardian is required.
  • If the contract is terminated due to the customer's violation of the preceding three paragraphs, we shall not be liable for any damages incurred by the customer, except in cases of our intentional misconduct or gross negligence.

Regarding Purchased Products

  • Cancellations, returns, or exchanges of ordered products are generally not permitted.
  • If the size, body color, quantity, etc., of the delivered product differs from the order details, please contact us within 7 days of arrival with the product unused.
  • Images viewed on your personal computer monitor may differ from the actual delivered product due to variations in monitors, hardware, settings, or fundamental differences in display and production methods. We cannot accept returns or exchanges based on these reasons.
  • For product defects attributable to us during manufacturing or shipping, we will replace the item with a new one.

Prohibited Actions

  • When using this service, customers must not engage in the following actions.
  • Actions violating laws and regulations, or infringing upon third-party intellectual property rights (including patent rights, utility model rights, design rights, trademark rights, copyrights, and other rights defined in Article 2, Paragraph 2 of the Basic Act on Intellectual Property Rights)
  • Acts causing economic or psychological harm to others, threatening acts, defamation of others, infringement of others' privacy or portrait rights, harassment, slander, obscene or vulgar, indecent, lacking in decency, abusive, offensive, leading to ethnic or racial discrimination, or otherwise problematic from an ethical standpoint.
  • Acts harmful to minors.
  • Impersonating another person, claiming to represent a company or other organization without authority, or falsely claiming affiliation or cooperation with another person or organization (including cases of misrepresentation based on intentional or negligent acts).
  • Acts that violate laws or regulations, whether intentional or negligent.
  • Other acts that violate these Terms of Use.

Cancellation Due to Violation of Prohibited Items

  • If we determine that the data you submitted may violate the above prohibited items, we may temporarily suspend production of the ordered items for verification.
  • Once verified, production will proceed; however, please note that the shipping date will be extended by the number of days required for verification.
  • If the order cannot be accepted following verification, an administrative fee of ¥220 (tax included) per item will be charged for the cancellation processing. Please also be aware of this.

Deletion of Member Information

  • If we determine that a customer has violated the content or intent of the Terms of Use, or has engaged in inappropriate behavior while using the service, we may suspend or delete that member's ID.
  • When we suspend or delete a specific ID, we may delete all information, saved data, and saved files associated with that ID, and prohibit future access to such information, data, and files.
  • If a customer is determined to be associated with anti-social forces, we may refuse membership registration, cancel existing registration, or cancel order information.
  • We shall not be liable to the member or any third party in connection with the deletion of member information.

Handling of Personal Information

  • Personal information received from customers will be handled strictly in accordance with our separately established Privacy Policy.

Disclaimer

  • The Company shall not be liable for any damages (including lost profits, lost opportunities, etc.) arising from the Customer's use of or inability to use this Service.
  • If the Customer causes damage to another Customer due to the use of or inability to use this Service, the Customer shall resolve such matters entirely at their own responsibility and expense.
  • Our liability for breach of contract regarding this Service shall be exempted unless caused by our intentional misconduct or gross negligence.
  • Due to the nature of this Service, which produces goods on demand, delivery delays may occur due to quality checks during inspection. We shall not be liable for any such delays.

Regarding Refusal to Accept Goods

  • This service produces goods to order based on customer requests.
  • If contact cannot be made for any reason, if goods are refused, or if goods are returned due to expiration of the carrier's storage period,
    the product cost and necessary fees will be charged at actual cost, regardless of the reason.

  • Return Processing Fee (¥2,200 including tax)
  • Certified Mail Issuance Related Expenses (Actual Expense)
  • Furthermore, please be advised that if we deem the situation malicious, such as when contact cannot be made or refusal occurs without valid reason, we may consider legal action.

Regarding Links

  • In principle, anyone is welcome to freely link to this service. However, please refrain from the following types of links.
  • Links that directly display images, videos, or other content from this service within the linking page.
  • Links that may cause misunderstanding regarding the relationship between the linking site and this service or our company.
  • Links from sites containing illegal content or content contrary to public order and morals.
  • Links made for illegal or improper purposes.
  • Links that may cause harm, such as damaging the credibility of this service or our company.

Disclosure of Information

  • We may store or disclose content and related information when we deem it necessary, including but not limited to: when required by law or legal process; to ensure compliance with these Terms; to respond to inquiries regarding content infringing third-party rights; when requested by rights holders to disclose information about content infringing intellectual property rights; or to protect the safety or public interest concerning this Service, users' property, rights, life, body, business, etc.

Governing Law and Jurisdiction

  • The formation, validity, performance, and interpretation of these Terms shall be governed by the laws of Japan.
  • Any dispute arising between the Company and the customer in connection with the Service or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
